TORT REFORM AND DAMAGE CAPS haven’t stopped doctors
and hospitals from committing malpractice…and that means we won’t stop fighting
for the victims of Texas.

MEDICAL
MALPRACTICE
Medical malpractice occurs when a
doctor, nurse, hospital employee, dentist or other medical worker acts in a
negligent manner when treating a medical condition. Medical malpractice can
occur through a health care provider’s action or inaction. Some examples
include:
-
Failing to diagnose or treat a
medical condition such as internal bleeding;
-
Failing to read an x-ray
correctly;
-
Failing to monitor a patient
during or after a surgery;
-
Performing an incorrect medical
procedure (operating at the wrong level on your back or cutting off the
wrong leg)
Medical malpractice cases are
complex, time consuming and expensive to pursue. We do all that is possible to
protect your interests, but we believe that people should enter into a medical
malpractice lawsuit with the realization of the challenges that are involved.
Tort reform and damage caps in
Texas have created significant obstacles to serious victims of medical
malpractice. Doctors, hospitals and insurance companies are often willing to
refuse to admit their mistakes, even where blatant, and vigorously fight the
charges. This can result in the unwillingness of experts to testify in cases
where they live in the same community as the physician charged with
malpractice. The lawyers at Thomas & Wan have an extensive network of expert
doctors and consultants across the nation. Our experts review potential cases
quickly and efficiently.

TOP FIVE TIPS FOR AVOIDING
MEDICAL MALPRACTICE INJURIES:
95,000 people are killed every
year because of the negligence of doctors and hospitals. 400,000 are victims of
negligence and misdiagnosis every year. Although it is difficult to avoid every
medical mistake, here are some tips when choosing a doctor:
1. Choose a caring, competent doctor. Follow your instinct.
If the doctor doesn’t answer your questions or if something doesn’t seem right,
dig a little further. Go to the internet and check with the
Texas Medical Board to
see if there have been complaints made against him or her. You can also review
local court records to see if he or she has been sued for malpractice.
2. Bring someone you trust – a friend, family member to help
you through this difficult decision. They can help you understand the issues
and ask questions that you may not have thought to ask.
3. Follow your doctor’s instructions. Unless you have reason
to believe your doctor is not properly treating you, follow your doctor’s
instructions when it comes to medication, diet and exercise.
4. Have a follow-up examination. After any treatment, visit
your doctor again to make sure that you are on the road to recovery. This is
especially important after any operations – if you report a problem early, it is
much easier to treat it early on than when it becomes a problem.
5. Get a second opinion. Doctors have different outlooks on
treatment. If it is a non-emergency surgery, find out what another doctor has
to say about it.
The bottom line is, talk to your
doctor and ask questions. Take responsibility for your health. If you are
uninvolved, you will be more at risk for mistakes or mistreatments.
