Disabilities That May Be Caused By Negligence

Does your baby have Cerebral Palsy?

Does your baby have HIE (hypoxic-ischemic encephalopathy)?

Is your baby not meeting his or her milestones (not feeding, not rolling over, not crawling, not walking, not talking)?

Is your baby in ECI or other therapies for his or her disabilities?

If you answered YES to any of the above, your baby’s disabilities may have been caused by negligence during labor and delivery.

NOT ALL DISABILITIES are caused by the negligence of a hospital or doctor during labor and delivery. For example, some disabilities are genetic, such as Down’s Syndrome. Genetic disabilities are not due to any negligence or malpractice. Likewise, some disabilities due to prematurity are not due to negligence or malpractice.

However, some injuries to babies may be caused by something that a nurse or doctor did or did not do during labor and delivery. Here are some SIGNS THAT SOMETHING MAY HAVE GONE WRONG:

Did you have a difficult delivery or emergency C-section?

Was your baby limp or blue at delivery? Not crying?

Was your baby resuscitated after birth?

Did your baby go to nicu?

Was your baby taken to a different hospital for a higher level of care?

Did your baby have total body cooling?

Did your baby have seizures after birth?

Did your baby have a stroke or seizures?

Did your baby have bleeding in the brain?

Did your baby have some type of infection?

Did your baby have meconium aspiration syndrome?


  • Not doing a C-section when needed
  • Not treating preeclamsia or other labor emergency
  • Not monitoring the baby’s oxygen or heart rate properly during labor
  • Not delivering the baby on time
  • Not treating mom for bleeding or other emergency
  • Improper anesthesia to mom during labor

Do I have a case?

The first step is for us to help you get the medical records of your labor and delivery, prenatal care, and baby’s pediatric records. Then we work with our team of expert doctors and nurses review the records to let us know if you have a case.

What kind of help can my baby receive?

If we feel you have a case, we will have our team of experts determine how much money it will take to pay for the past medical bills and future quality medical care for your child for the rest of his or her life. We can also help you with obtaining Social Security disability payments if you qualify.

How much do you charge?

We work on a contingency basis. This means that you only pay a percentage for our services if we win a verdict or settlement for your family. If no recovery is made, you pay nothing.

Why should we hire you?

Michelle W. Wan — has worked exclusively representing clients in personal injury matters. She has handled numerous matters involving toxic exposures, medical negligence and product defects. Like Thomas, Wan has dedicated her career to fighting on behalf of persons injured by the negligence, recklessness and carelessness of others. Wan and Thomas work as a team in trial, and Wan enjoys the ability stand in front of juries and bring her clients’ side of the story to the light of a courtroom. She is a 2001 graduate of The University of Texas School of Law where she served on the editorial board of the legal journal The Review of Litigation. As a former law journal editor, she enjoys in-depth legal research and strives for concise and clear writing. As a former paralegal, Wan understands the organization and efficiency necessary for plaintiff’s litigation. She was a National Merit Scholar and earned a B.A. from Rice University.
