The evidence showed the child arrived at the emergency department alive but critically ill with dangerously low oxygen levels and inadequate breathing. Despite the obvious airway emergency, providers delayed intubation and failed to properly oxygenate him while his condition rapidly deteriorated.
During the delayed and unsuccessful intubation attempts, medications causing paralysis were administered before a secure airway had been established, leaving the child unable to breathe on his own. His oxygen levels plummeted, leading to cardiac arrest and a severe hypoxic brain injury.
As a result of the injury, the child suffered permanent neurological damage requiring lifelong medical care, therapy, assistance with daily living, and extensive supportive services.
